• Arbitration shall be conducted in Virginia, or remotely via secure video conference at the election of the parties
• Arbitration shall be conducted on an individual basis only
• Class actions and representative actions are expressly waived

Notwithstanding the foregoing, the Company may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or proprietary rights.
